This Terms of Use Agreement “Agreement” is a legal agreement between you (“User”) and Machineart, Inc. that governs your use of this website. By utilizing this Machineart, Inc. website, User acknowledges that he or she has read, understood, and agrees to comply with the terms and conditions stated within this Agreement.

Machineart, Inc. may amend these terms and conditions at any time. User’s continued use of this website constitutes acceptance of the terms and conditions stated at the time of use.

Corporate Identification and Trademarks

The content of the MachineartMoto site is proprietary to Machineart, Inc. and is protected by intellectual property laws. All registered and/or unregistered trademarks and/or service marks (collectively, “Marks”) used or referred to on this website are the property of Machineart, Inc. unless otherwise noted. Users may not use, copy, reproduce, republish, upload, post, transmit, distribute or modify these Marks in any way for any purpose without prior written permission from Machineart, Inc.

Limitation of Liability

Machineart, Inc. makes no express or implied warranties of any kind. Customer agrees that use of the service is entirely at customer’s own risk. Services are provided ‘as is,’ without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the service. Specifically, we disclaim any and all warranties, including without limitation: 1) any warranties concerning the availability, accuracy or content of information, products or services; and 2) any warranties of title or warranties of merchantability or fitness for a particular purpose. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action. Neither the service nor any of its agents, affiliates or content providers shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the service or inability to gain access to or use the service or out of any breach of any warranty. Customer hereby acknowledges that the provisions of this section shall apply to all content on the service.

Indemnification

User agrees, at User’s expense, to indemnify, defend and hold harmless Machineart, Inc., its officers, directors, employees, agents, affiliates, distributors and licensees from and against any judgment, losses, deficiencies, damages, liabilities, costs and expenses (including reasonable attorney’s fees and expenses) incurred in connection with or arising from any claim, demand, suit, action or proceeding arising out of User’s breach of this Agreement or in connection with User’s use of this website or any product or service related thereto.

Venue and Governing Law

This Agreement and the relationship between User and Machineart, Inc. shall be governed by and construed in accordance with the laws of the State of New Jersey. Any controversy or claim arising out of or relating to this Agreement or relating to use of this website and the material contained in this website shall be resolved in a federal or state court in Hunterdon County. User agrees that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to this Agreement must be filed within one (1) year after such claim or cause of action arises or it will be forever barred.

Waiver/Severability

The waiver by either party of a breach or right under this Agreement will not constitute a waiver of any subsequent breach or right. If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of this Agreement, which will otherwise remain in full force and effect.

Terms of Use

Products are made available on the condition of your acceptance of the terms, conditions, and notices contained herein without modification. If you do not agree to these terms, return Product(s) within 10 days, including the packaging and all written materials, to MachineartMoto.

Shipping

Products are shipped via the carrier chosen during checkout, and you are sent a confirmation email through the respective carrier. For any claims of non-delivery, you must contact the carrier to obtain its transport and delivery record. MachineartMoto bears no responsibility for any shipping delay or failure to deliver by the carrier, nor any loss of goods after delivery by the carrier to the addressee’s location.

Shipping Damage

Products are well packed and in good condition when shipped. If an item is damaged en route, please make a claim directly with the carrier. You may re-order your item(s) after reimbursement.

Warranty

We warrant products against manufacturing defects for a period of 60 days from the original invoice date. If you receive a defective item, please call us for a return authorization. A copy of the original sales receipt must accompany returns. A credit will be issued or a replacement will be sent after we have received the defective item. Products that have been used for any purpose other than our stated intent or installed by an unqualified technician are not covered by this warranty. Crash damage, damage due to handling and normal wear are not covered by this warranty. Warranty is valid only for the original owner verifiable by the original purchase receipt. Labor costs incurred installing a defective item will not be considered for credit.

Return Policy

Returns are accepted within 10 days of purchase. You must contact us at 908. 652. 6779 for a Return Authorization prior to sending the item back. We will not accept any packages returned without authorization. Except for warranty returns, all returned merchandise is subject to a 15% restocking fee.

Used / Damaged / Blemished Merchandise

Any returned product must be in new condition, not have been installed or damaged, and be in its original packaging with packing contents. Any item showing signs of use (wear, bugs, dirt, scratches, smell, pet hair, scuffing, stains, etc) or is not in its originally shipped condition cannot be returned.
If a returned item is not in complete, salable condition, no refund will be made.

For warranty returns due to manufacturing defects over the duration of the 60 day warranty period, we will offer a credit to exchange the item for another product or give a refund in the form in which the original payment was made.

With the exception of returns for warranty or our shipping error, you are responsible for return shipping costs.

Back orders

Our items are manufactured in small quantities and may be back-ordered at times. We will inform you of stock availability at the time the order is placed and you will have the option to place the item on back-order or not. As the product becomes available, the back-ordered item(s) will be shipped to you automatically.

Installation Instructions

All MachineartMoto products should be installed by a qualified motorcycle technician. Installation instructions are provided for your information and convenience. Improper installation may cause injury or death. MachineartMoto is not responsible for any damages or loss of property which may result from installation, improper or otherwise, or use of the Product. No warranty of any kind,  expressed or implied, is made regarding the safety of this Product. Failure to follow recommended installation and use instructions voids the warranty. By installing these products, user accepts all liabilities, terms and conditions outlined in the Liability & Warranty statement included herein.  

Installation instructions are written based upon our current state of knowledge. Information is provided without any guarantee as to its accuracy and is subject to revision.

Important

Before riding, sit on the machine and confirm that there is no interference with your ability to operate and ride the motorcycle safely. Check all controls, their cable paths, and part clearances to re-confirm that they are operating normally.

Privacy information

Machineart, Inc. is the sole owner of the information that it acquires from users in the course of taking orders. We do not share customer information with third parties, with the exception of an e-mail address so that a customer order acknowledgement can be emailed to the customer automatically. When an order is placed, we collect the customer name, phone number, email address, billing address, mailing address, bike model, and credit card type, number, and expiration date. This allows us to process the order and notify you of the order status. Customer personal information will not be sold. When you place orders, the secure server software (SSL) encrypts all information before it is sent to us. Customer data is protected against unauthorized access.
